1. General These General Terms and Conditions apply to all business relationships between the Seller and its customers in Switzerland initiated or concluded via www.outdoor-lounge.ch. The Seller is "Outdoor Lounge" with its registered office in Cham. The version of the GTC valid at the time of the conclusion of the contract applies exclusively. Differing contractual conditions of the customer are not recognized by the Seller.

2. Scope of Offer, Prices, and Orders

  • 2.1. All prices are in Swiss Francs (CHF) including VAT and exclude delivery. Home delivery costs are not included in the price and must be selected separately.

  • 2.2. Price changes and errors are reserved.

  • 2.3. The items offered on www.outdoor-lounge.ch can be ordered online via the eShop. The information required for the order must be provided truthfully. By submitting the order, the customer acknowledges these General Terms and Conditions.

  • 2.4. The order is binding. An order confirmation will be sent by the Seller via email.

  • 2.5. Cancellation of a binding order will incur a cancellation fee of CHF 250.00.

3. Delivery Conditions

  • 3.1. Ordered items are made available as quickly as possible, generally within 10–18 working days, provided the item is in stock. Handover/Dispatch occurs only after receipt of the full invoice amount.

  • 3.2. The customer must choose an option: Delivery or Self-Pickup in Uznach. Delivery dates require flexibility from both the buyer and seller.

  • 3.3. The Seller is entitled to make partial deliveries.

  • 3.4. If a product is not available within the stated deadlines, the customer will be informed. If the delay exceeds 16 working days, the customer may withdraw from the contract within 5 days of notification (unless the catalog expressly states a longer term).

  • 3.5. Delivery costs cover transport to the delivery address specified in the order confirmation, provided there is road access for a delivery truck.

  • 3.6. Benefit and risk transfer to the customer upon pickup or dispatch. Transport insurance is the responsibility of the customer.

  • 3.7. Access & Furniture Lift: The customer must ensure the furniture fits through doors/staircases. We do not provide a furniture lift; this must be organized by the buyer. If the furniture cannot be transported into the house (e.g., entrance too narrow), the courier is entitled to leave the delivery in front of the house. In narrow passages, the buyer assumes the risk of damage to the property or furniture.

  • 3.8. Inspection (Deluxe Delivery): For Deluxe deliveries, the customer is obliged to report any defects or incomplete items to the courier immediately on-site. Complaints must be noted in writing on the delivery note. By signing, you accept the delivery. Defects cannot be reported retrospectively.

  • 3.9. Missed Delivery: Cancellation of a delivery appointment is free up to 3 days prior. Short-notice cancellations (<3 days) incur a CHF 150.00 fee. If the courier arrives and no one is present, full delivery costs will be charged.

  • 3.10. Self-Pickup: Pickup in Uznach must be scheduled by phone. Loading the vehicle and disposing of packaging are the buyer's responsibility. Immediate inspection for defects is required upon pickup.

4. Payment Conditions

  • 4.1. Purchase price and delivery costs are due immediately upon order confirmation (Credit Card) or upon delivery/pickup (Cash).

  • 4.2. Payment must be made before the goods are handed over.

  • 4.3. If paying by Credit Card, the ordering customer must be the cardholder.

  • 4.4. All amounts must be paid in Swiss Francs.

  • 4.5. Late payments incur 5% interest per annum plus a strictly enforced reminder fee of CHF 20.00.

5. Warranty

  • 5.1. We provide a 24-month warranty. The warranty covers the construction of the furniture under normal use.

  • Exclusions: Wear and tear, color changes, and structural changes in wood are excluded. In the event of a defect, the buyer is not entitled to a refund. The warranty is limited to repair or exchange. The first warranty exchange is free (unless Self-Pickup was chosen); subsequent exchanges incur transport costs.

  • 5.2. Outlet Items: Reduced items and "Goodies" are excluded from the warranty.

  • 5.3. Manufacturer Exclusions: The following are NOT covered:

    • Normal wear and tear.

    • Wrinkles in fabric (natural result of use).

    • Softening of Quick Dry Foam after regular use.

    • Improper use or care.

    • Stains from food, liquids, or color transfer from clothing.

6. Retention of Title Ownership remains with the Seller until full payment is received. The Seller may register this in the retention of title register and reclaim goods in case of payment default.

7. Liability & Defects

  • 7.1. The warranty period is 24 months.

  • 7.2. The customer must inspect goods immediately. Failure to report defects immediately in writing voids the warranty claim.

  • 7.3. Natural aging processes are not defects.

  • 7.4. The customer has a right to Repair (Rectification), but not to Replacement or Price Reduction. The Seller decides whether to repair or replace.

  • 7.5. Liability for damages (direct or indirect) and lost profits is excluded to the extent permitted by law.

8. Right of Return

  • 8.1. Exchange of faultless goods is excluded. Returns are only permitted for incorrect deliveries.

  • 8.2. If an item is no longer available, the Seller may withdraw from the contract without compensation.

  • 8.3. Outlet items are final sale.

9. Data Protection Customer data is stored for internal processing and is not passed to third parties unless necessary for contract fulfillment (e.g., delivery courier).

10. Intellectual Property All designs and content on www.outdoor-lounge.ch are copyright protected. Reproduction is prohibited.

11. Jurisdiction Swiss Law applies exclusively. The place of jurisdiction is Wollerau.
